On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgment of the Court of Appeals, REINSTATE the June 13, 1986 order of the Berrien Circuit Court, and REMAND this case to the Berrien Circuit for new trial. The Berrien Circuit Court did not clearly err in its determination that it ""cannot determine the true intent of this jury"" and in its resultant decision to order a new trial. We do not retain jurisdiction.
